The San Diego Municipal
Code addresses public nuisance noise in Chapter 5, Article 9, Division 5.

PUBLIC NUISANCE NOISE
SEC. 59.5.0501 GENERAL
PROHIBITIONS
"A. It shall be
unlawful for any person to make, continue, or cause to be made or
continued, within the limits of said City, any disturbing, excessive, or
offensive noise which causes discomfort or annoyance to any reasonable
person of normal sensitiveness residing in the area."

Nuisance Abatement Process

cars parked in front yards, anything that “interferes with the comfortable
enjoyment of life or property.”

These Steps (all contact
information at bottom):
1.
Both groups and individuals can follow these steps, but having a group makes
it easier. Neighborhood Watch is a great way to form a group that
works directly with the police.
2. Keep an "Activity Log" to document ALL occurrences of
nuisances/crimes - what happened, how it affected you, and what you did
about it. Include identifying detail about people and vehicles. Record
everything you do to resolve the problem (e.g., complaints filed, agencies
contacted, communication with tenants and property owner, etc.) This log
is an essential document to keep throughout the entire process.
3. Every time a nuisance occurs, call the SDPD Non-emergency number and
get an incident number and record it in your log. Even if the police
are not able to respond, it is essential for you and your neighbors to
call. The police use the record of these calls to allocate staffing and
resources. If the nuisance is a party house, repeated calls to the
police may trigger CAPP (Community Assisted Party Program), a special
program that cracks down on repeat violators. Contact CAPP directly to see
if the property has been entered into that program.
4. Contact
Neighborhood Code Compliance Department (NCCD) to give incident number and
file complaint. If 3 or more
people have called NCCD with incident numbers, then NCCD will investigate
and send a letter to the property owner and tenant.
5. If the nuisance is a business with an alcohol license, contact
all of these agencies and file a complaint. Enforcement is
complaint driven!

If a serious crime or nuisance is occurring
such as drug dealing, gang activity, or serious code violations, contact
DART (Drug Abatement Response Team.)
6.
If the nuisance continues, contact Neighborhood Nuisance Program (NNP).
NNP will help you through the process of preparing for civil action (small
claims court). This successful program usually results in cessation of the
nuisance long before it gets to court.
